1. Who we are
Approxination (“we”, “us”, “our”) provides an API that aggregates third-party large language models (“Service”). We sell usage tokens/credits (“Tokens”) that can be redeemed for API calls. Billing and tax collection are handled by Paddle, our Merchant of Record; your card statement may show Paddle.
2. Accounts & Eligibility
You must be at least 18 and able to form a contract. You’re responsible for the security of your keys, credentials, and usage.
3. What Tokens Are (and Aren’t)
Tokens are prepaid usage credits for our Service. They are not a stored-value instrument, deposit, security, or cryptocurrency. Tokens have no cash value, are non-transferable (unless we agree in writing), and are subject to expiry as stated at purchase or in your dashboard.
4. Third-Party Models
We route requests to models operated by third parties. Their uptime, behavior, and content filtering can affect results. We may change model vendors at any time.
5. Acceptable Use
Don’t use the Service to: break laws; infringe IP; generate malware; violate privacy; harass; or process special-category personal data without a lawful basis. If we believe use is abusive or high-risk, we may rate-limit, suspend, or terminate.
6. Outputs & Reliance
AI outputs can be inaccurate or unsafe. You’re responsible for review and human oversight, especially for medical, legal, or financial use. We provide the Service “as is” without warranties.
7. Billing via Paddle
Paddle (and/or its affiliates) acts as Merchant of Record, handling checkout, invoicing, taxes, and buyer support for payments and refunds per Paddle’s buyer terms.
8. Fees, Expiry & Taxes
Prices exclude applicable taxes unless stated. Taxes are determined and collected at checkout (by Paddle). Unused Tokens may expire per the purchase screen. We can change pricing prospectively.
9. Refunds
See our Refund & Cancellation Policy. Your statutory consumer rights (e.g., EU/UK) may apply.
10. Confidentiality & Data
See our Privacy Policy for how we handle prompts, outputs, logs, and billing data.
11. Limitation of Liability
To the maximum extent permitted by law: (a) we’re not liable for indirect or consequential loss, lost profits, or loss of data; and (b) our total liability for claims in any month is capped at the fees you paid to us for that month.
12. Suspension/Termination
We may suspend or terminate for breach, legal risk, or abuse. You may stop using the Service at any time; see Refund Policy for any credit remedies.
13. Changes
We may update these Terms. Material changes take effect when posted; continued use means acceptance.
14. Governing Law & Disputes
These Terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction, except where consumer law requires otherwise.

Privacy Policy

1. Controller & Scope
Approxination is the controller for data we process to run the Service. Paddle acts as Merchant of Record and processes buyer data for checkout/tax in accordance with its own privacy policy.
2. Data We Collect
- Account: name, email, password hash, workspace/org, settings.
- Billing: purchase details, country, tax/VAT info (handled by Paddle).
- Usage: prompts, outputs, model selections, timestamps, token spend, IP, user agent.
- Logs/Telemetry: performance metrics, errors, fraud signals.
- Optional: your third-party API keys if you choose to store them (encrypted at rest).
3. Why We Use Data (Legal Bases)
- Provide Service & billing (contract).
- Prevent abuse & ensure security (legitimate interests).
- Comply with law/tax (legal obligation).
- Improve the Service (legitimate interests).
We don’t use your prompts/outputs to train public models unless you explicitly opt-in.
4. Sharing
We share data with:
- Paddle for payments/tax and buyer support.
- Cloud hosting, email, and analytics providers (sub-processors).
- Law enforcement when required.
5. International Transfers
We use global infrastructure. Where required, we use Standard Contractual Clauses (SCCs) or similar safeguards for data transfers.
6. Retention
- Prompts/outputs/logs: retained for 30 days for debugging/billing unless you opt for shorter retention.
- Billing records: retained as required by tax laws.
7. Your Rights
Where applicable (e.g., EU/UK GDPR): you have the right to access, rectify, erase, restrict, portability, and object. Contact us or lodge a complaint with your local authority.
8. Security
We use encryption in transit and at rest, access controls, and monitoring. No method is 100% secure.
9. Children
Our service is not for use by individuals under 18.

Refund & Cancellation Policy

1. Overview
Because Tokens are usage credits for immediate access to digital services, purchases are generally non-refundable, except where required by law or under the guarantees below.
2. Merchant of Record & How to Request a Refund
Paddle is our Merchant of Record and handles payment support and refunds on our behalf. For charge lookups or refund requests, use the Paddle order portal (paddle.net) or contact us and we’ll coordinate with Paddle.
3. EU/UK Right of Withdrawal (14 days)
If you are a consumer in the EU/UK purchasing digital content, you generally have 14 days to withdraw unless you explicitly consent to immediate performance (instant access) and acknowledge you’ll lose the right to withdraw once performance begins. Our checkout captures this consent for instant access.
If you do not consent to immediate access, you can withdraw within 14 days; we will disable access and issue a refund as required.
4. Defective or Not-as-Described Service
Where outputs or access are materially unavailable due to our systems (excluding third-party outages beyond our control), we’ll re-credit Tokens or refund the unused portion as required by consumer law.
5. Downtime Credits (SLA-Style)
If monthly uptime drops below 99% due to our systems, you may request a 10% credit of that month’s Token spend. Credits are the sole remedy for SLA breaches.
6. Subscriptions & Cancellations
You can cancel auto-renewing plans anytime before the renewal date in your billing portal; future periods won’t be charged, and access continues until the end of the paid term. Past periods are not refunded unless required by law.
7. Abuse & Fraud
We may refuse refunds for fraud, refund abuse, or manipulative behavior, consistent with Paddle buyer terms and applicable law.
